1. INTRODUCTION In all motor accident cases, several factors may influence your actions some of which may be uncalled for. We therefore advise that in all situations, first and foremost:-
i. Report the case to the Police ii. Report to us and complete an Accident Report form iii. Submit a photocopy of your driving license and make the original available for inspection. iv. Submit all Claims, Writs, and letters unanswered to us. v. Do not admit liability or make any payment or offer of payment without our consent. vi. Do not effect repairs before we inspect the damage and give consent for repairs.
On several occasions we are not sure as to who is qualified to make a claim. In the event of an accident, the :-
i. The Policy Holder (the Insured) ii. Any one who’s property has been destroyed by the insured vehicle iii. Any injured victim(s) iv. The Administrator of a deceased’s estate v. The parents or guardians in the case of a minor.
We do not request claimants to engage the services of a lawyer; engaging the services of a lawyer is a matter of Choice.
2. PERIOD LIMIT WITHIN WHICH TO MAKE A CLAIM In registering claims, there is a limited period within which to make a Claim:-
i. Injury/Death-up to three years from date of accident. ii. Damage-Up to six years from date of accident.
To make a clam, kindly write to us as soon as possible provided that it is within the above stated period.
3. DOCUMENTS REQUIRED WHEN LIABILITY IS ACCEPTED When we accept Liability for a Motor Claim, there are a few documents we will require to complete the Claims process and these vary depending on the type of Claim.
Injury claims related to road traffic accident • Original Police report • Original medical report • Original receipts of medical bills incurred (to justify cost being claimed for) • Personal particulars • Two passport size pictures to be endorsed by the medical officer and an • Affidavit
Deceased claims (Death) • Original Police report • Death certificate or burial permit. • Personal particulars of the deceased. • Affidavit • Two passport size pictures to be endorsed by the medical officer • Letters of administration. • Registrars certificate where the deceased is below 18 years
Property Damage Claim • Original Police report • An estimate of the cost of repairs. • Pictures of the damaged property. • Affidavit • A valuation or survey report from our engineers.
4. CIRCUMSTANCES UNDER WHICH A CLAIM MAY BE REPUDIATED The are circumstances when a claim may be repudiated. Some of the factors that may be attributed to the repudiation include:-
• Where an unlicensed person was driving. • Where there was no insurance cover at the time of the accident. • Where the vehicle insured in question has a change of ownership. • Where the claim was not submitted within the acceptable period. • Where the vehicle is being used without the Insured’s consent. • The vehicle is being used for unauthorized purposes. • Using the vehicle for drunk driving.
In all cases, a police report is needed to establish Liability. We promise to issue cheques for payment of a claim within 90days after it has been settled.
